Abstract:
The study of the conclusion of the contract in the Omani
e-Transactions Law clarifies the concept and components of the
e- contract. Due to importance of this contract which reflects
willingness to utilize electronic means such as the Internet, this
reasech paper introduces the way how both parties of the e- contract
accept or reject its terms, and clarifies the electronic means used
express such willingness showing the acceptable cases to legally
validate the issuance of the letters by their own sources.
In addition, this study introduces the cases of agreement
on acknowledging the receipt of e- message, the way such
acknowledgement.
The reseach also tackles venue and time of the conclusion of the econtract,
and shows the cases stated in the Omani e- Transactions
Law that determine venue and time of the conclusion of the econtract.
Besides, this work investigates the e- signature used to verify
e- contracts, by clarifying its concept, types and conditions, the
parties submitting e- endorsement services and the approval
certificate issued to attest e- signature authenticity.
The research work ends up with a number of suggestions relevant
to the conclusion of the e- contract.
