The Relationship between the Principle of Equitable Utilization and no Harm Principle in the Law of International Rivers (Priority or Integration)

Abstract

This study discusses the relationship between the two key principles in the law of international rivers; namely the principle of equitable and reasonable utilization and the principle of non-harm. Despite the fact that these principles are recognized in international law, their relationship is not clear. Therefore, the question arises: is the relationship between the two principles a priority relationship; namely that one above the other and preceded in the application, or an integration relationship; namely the two principles should be applied together in a balanced manner? This study proves that the relationship between the two principles is based on the fact that both principles stand on an equal footing with the other. Inddition, the relationship between them is not a priority relationship, but an integration relationship based on the application of two principles together. Any State can benefit the international river in anequitable and reasonable manner, provided it does not harm the rights and interests of other riparian states.
